You can purchase using the functions available in the store. Guest checkout is available when this option is shown at checkout.
A consumer is an individual purchasing outside their trade, business, craft or profession. Special consumer rights do not automatically apply to professional purchases. Such purchases are governed by the accepted offer, the contract and general law; a 14-day commercial return right is not granted by default.
Orders and conclusion of the contract
Check the model, configuration, quantity, address and billing details before submitting your order. Correct any errors in the form or notify us immediately. Do not submit third-party data without a legitimate reason.
The technical registration of a request and assignment of a number do not, by themselves, confirm acceptance. The contract is concluded when we communicate acceptance of your order on a durable medium, usually by email. A message expressly confirming acceptance has this effect; we do not arbitrarily defer conclusion of the contract until delivery.
Before acceptance, we may refuse a request for justified reasons, such as actual product unavailability, inability to deliver, failure to confirm a payment due or objective indications of fraud. We inform you of the reason and refund sums received for an unaccepted order without undue delay. The store cannot cancel an already concluded contract at its discretion.
An obvious pricing or description error is checked and communicated promptly. We do not charge a different price or substitute a product without agreement. If we cannot reach a solution, the legal rules on contracts and error apply, rather than a general right for the store not to fulfil the order.
Prices, payment and availability
The final price payable, VAT and any additional charges are presented before you accept the obligation to pay. For a consumer, the total price includes applicable taxes; any price excluding VAT is clearly labelled supplementary information. Subsequent price changes do not alter concluded contracts.
Only payment methods actually offered for the particular order may be used. Cash on delivery or bank transfer may be subject to conditions depending on the products and destination. For payment by transfer, use the details in the confirmation. We do not request full card details or the security code by email or telephone.
For products ordered on request, any reservation, advance payment and payment deadline must be communicated and accepted before conclusion of the contract. Merely using the website does not create an automatically non-refundable advance payment. Availability at a supplier does not mean physical stock in our warehouse.
Discounts, coupons and their combination apply according to the campaign conditions displayed before purchase. A coupon cannot be exchanged for cash unless expressly provided or required by law. A product discount does not remove withdrawal or conformity rights.
Delivery and receipt
The delivery method, cost and deadline are those presented and agreed before the contract. Unless we have expressly agreed a different deadline, we deliver without undue delay and within 30 days of conclusion of the contract. In the event of delay, statutory rights concerning an additional delivery period and, where applicable, termination of the contract and reimbursement apply.
For consumers, the risk of loss or damage passes when you, or a person you designate other than the carrier, physically receive the goods. The statutory exception concerns a carrier selected and commissioned by you where we did not offer that option.
Help us by providing accurate details, access to the handover location and prompt notification of incidents. We recommend photographing a damaged parcel and recording observations; the absence of a written damage report or notification within 24/48 hours does not extinguish statutory rights. Any justified additional cost is communicated in accordance with the law, without automatic disproportionate penalties.
Withdrawal, guarantees and use
For a change-of-mind return, the customer pays the direct cost of return transport. We do not charge processing or restocking fees. If we have expressly agreed a free return, we honour that agreement. For defective, non-conforming or incorrectly dispatched products, we bear the costs necessary to remedy the issue, including transport, in accordance with the law.
A consumer purchasing at a distance has 14 days to communicate withdrawal, subject to the conditions laid down by law. The return procedure explains deadlines, costs, reimbursement and exceptions. An exchange or voucher is an express choice, rather than a replacement for reimbursement imposed on you.
New goods benefit from a two-year legal guarantee of conformity from delivery under Government Emergency Ordinance (OUG) no. 140/2021. This is a statutory right, rather than an exclusive store benefit. Repair or replacement is free of charge; price reduction and termination of the contract apply in the circumstances provided by law. The manufacturer’s commercial guarantee does not limit these rights.
Follow the product instructions, maintenance requirements and intended use. Normal wear, accidents and improper use do not, in themselves, constitute non-conformities attributable to the seller. Any exclusion is assessed in relation to the cause of the defect and the statutory burden of proof; merely opening the packaging or using a third-party accessory does not automatically extinguish all rights.
For goods with digital elements, statutory obligations concerning updates necessary to maintain conformity also apply. Product-specific information on durability, repairability, parts and any commercial guarantees is provided for the relevant product to the extent required by law.
Website use and content protection
Texts, photographs, trademarks and graphics are protected according to their owners’ rights. Browsing and normal use for purchasing are permitted. Commercial reproduction, presenting content as your own or using trademarks misleadingly requires a legal basis or the rights holder’s permission.
Fictitious orders, unauthorised access, exploitation of vulnerabilities and disruption of the service are not permitted. We may take proportionate technical measures against documented abuse without preventing the exercise of a statutory right, access to order information or the resolution of a complaint.
Photographs and descriptions identify the product and included accessories. Normal differences in screen display do not justify delivering a different model, a different configuration or non-conforming goods. We do not use the phrase “images are for illustration” to set aside our obligations.
Complaints, liability and applicable law
To resolve an issue, send contact@alphaboat.ro your order reference, the product and a description of the issue; photographs may help but are not a universal requirement. You can also use the contact form. We do not require you to exhaust an internal procedure before contacting an authority or court.
We may rely only on limitations, grounds for exemption and remedies permitted by law and substantiated in the particular circumstances. We do not exclude liability for intentional conduct, gross negligence, injuries or mandatory obligations. A supplier or courier delay is not automatically declared force majeure.
Romanian law applies without depriving consumers of mandatory protection under the applicable rules. Disputes fall within the jurisdiction of the courts competent under the law; we do not impose exclusive jurisdiction of the court at the company’s registered office on consumers. Available options include ANPC and alternative dispute resolution (SAL).
The applicable version is the one communicated when the contract was concluded. Website updates do not retrospectively change orders. If a clause cannot take effect, the others remain applicable to the extent permitted by law. Also consult the personal data notice.
